FCO - Terms and Conditions of Gym Membership

Unlike many gyms our membership does not have any one of sign up or cancelation fees, we also do not have any forced length of membership. We believe you should be free to use the gym how you wish to and should you be unable to use these facilities due to any number of reasons you should not be tied to a contract.


Should you feel the service is not up to what you expected when you became a member, please ensure you discuss what you feel could be improved with our gym staff, FCO Gym we try our best to provide the highest quality of experience for our users and try to ensure all individual needs are met as to the best of our ability.


We do however have some terms and conditions related to our gym membership, so please take a look at the following:

 

 

Payment

1.A Our Direct Debit guarantee is offered by all banks and building societies that accept instructions to pay Direct Debits.

1.B Direct Debit payment will be taken on 22nd of each month for all members, with the first payment taken in the month that you join so even if you join after the 22nd FCO Gym (James Corporate Health) will back date the first payment.

1.C If there are any changes to the amount, date or frequency of your Direct Debit JCH Ltd will notify you (normally ten working days) in advance of your account being debited or as otherwise agreed. If you request JCH Ltd to collect a payment, confirmation of the amount and date will be given to you at the time of the request.

1.D If an error is made in the payment of your Direct Debit, by JCH Ltd or your bank or building society, you are entitled to a full and immediate refund of the amount paid from your bank or building society. - If you receive a refund you are not entitled to, you must pay it back when JCH Ltd asks you to.

 


Cancellation

2.A Should you wish to cancel your Direct Debit FCO Gym (James Corporate Health) we will of course be sad to see you go, however you will be charged for the month you cancel in but not more and we request that you give us notice in writing in the form of a cancellation form that we will send you once requested. 

2.B FCO Gym (James Corporate Health) may cancel your membership without notice if you commit a material breach of this agreement including, but not limited to, a breach of the Club Rules, abuse or threatening behaviour or vandalism or other illegal activity.

2.C FCO Gym (James Corporate Health) may cancel your membership with immediate effect if:

i. you have breached any terms and conditions of this agreement; or
ii. membership fees or other charges remain unpaid 7 days after the due date and such a
iii. breach is not remedied by you within seven days, after being notified by us.

 


Membership

3.A You must complete the PAR Questionnaire before you start using your membership and by completing the PAR Questionnaire warrant to us that you have no known condition or are undergoing any treatment that would prevent you from being capable of physical exercise in all material respects.

 

3.B On entry into this Membership Agreement and every time you enter the FCO Gym during your membership, you warrant and represent to FCO Gym (James Corporate Health) that you have no medical conditions known to you that would mean that you are not capable of all forms of exercise and that such exercise will not be detrimental to your health. If in doubt, it is your sole responsibility to consult a medical practitioner or to cancel your membership.

 

3.C You will receive a door code when you join. If you have forgotten your door code please email reception@ejphysio.co.uk

 

3.D Your membership applies to you personally: you cannot lend, assign or transfer it to another person.

 

3.E FCO Gym (James Corporate Health) reserve the right to implement a class or gym use waiting list at any time if FCO Gym (James Corporate Health) deem it necessary to do so.

 

 

Club Usage

4.A You must familiarise yourself with the FCO gym rules before use. Rules are displayed in the reception. FCO Gym (James Corporate Health) may cancel or suspend your membership without notice if you break these rules.
i. You must wear appropriate clothes and shoes in the Clubs.
ii. Please ensure equipment is wiped down after use.
iii. Weights must not be dropped, and must be replaced after use.
iv. Lockers in the changing area are for use when in the gym only – any contents in occupied lockers will be emptied regularly and contents will be donated to charity after 2 weeks if they remain unclaimed.
v. You must not abuse the equipment or facilities of a Club (you will be liable to pay for any negligent or deliberate damage to property).
vi. You must not behave in a violent, rude or threatening way or in a manner which distresses or causes discomfort to other members of the gym or gym staff.
vii. FCO Gym (James Corporate Health) ask that our members are considerate of others and request permission if using any photographic or video equipment within the gym space.
viii. Smoking, including the use of e-cigarettes is not allowed in any part of a Club. Possession of alcohol, narcotics or other mood-altering substances is not permitted, neither is the use of a Club while under the influence of any of these substances.

 

4.B FCO Gym (James Corporate Health) may refuse admission to or ask you to leave the FCO Gym reasonably if FCO Gym (James Corporate Health) believe that you have broken any section of this paragraph. No refund will be given if you are asked to leave a in such circumstances.

 

4.C Members must secure their personal belongings on their person or place and secure them in the lockers provided by us at all times whilst using FCO Gym facilities. Your property is left in these lockers entirely at your own risk.

 

4.D You are responsible for ensuring that you correctly operate or use any facilities and/or equipment (including adjusting levels or settings) which FCO Gym (James Corporate Health) provide. If you are in any doubt about how to correctly operate any equipment, you must consult one of our representatives before use.

 

4.E Classes included in membership will be staffed and run as often as possible and FCO Gym (James Corporate Health) continuously aim to supply classes to meet the demands of our client base on a 4 or more basis. If you feel a certain type of class / timing of class should be run and can generate interest in at least 4 attendees FCO Gym (James Corporate Health) will assess the viability of this class and try our best to supply it.

 

4.F FCO Gym (James Corporate Health) do reserve the right to cancel classes in the event of continued poor attendance and suspend classes due to staffing issues such as sickness and annual leave. FCO Gym (James Corporate Health) shall ensure that attendees are given as much warning of any such alterations to class schedules as soon as possible via notices within the gym or email if sign up lists are used for the class in question.

 

 

Force Majeure

5.A For the purposes of this agreement, a Force Majeure Event means an event beyond the reasonable control of FCO Gym (James Corporate Health) including but not limited to strikes, lock-outs or other industrial disputes, failure of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default of suppliers or subcontractors.

 

5.B FCO Gym (James Corporate Health) shall not be liable to you as a result of any delay or failure to perform its obligations under this agreement as a result of a Force Majeure Event.

 

5.C If the Force Majeure Event prevents FCO Gym (James Corporate Health) from providing any of the services for more than 90 days, FCO Gym (James Corporate Health) may, without limiting its other rights or remedies, have the right to terminate this agreement immediately by giving written notice to you.
